  1. What is the purpose of these Terms?

These Terms and Conditions of Use (TCU) define the rights and obligations of users and GoDactyl regarding the use of the application and associated services. They govern the terms of access and use of the platform.

  1. When do the Terms take effect and for how long?

These TCU take effect upon the creation of your GoDactyl account and apply as long as the account remains active. In the event of termination or deactivation of your account, these TCU will cease to apply.

  1. How are you billed?

Subscription payments are monthly and automatically renewed on the 5th of each month. This rule applies to all individual and professional accounts. For businesses, billing is centralized and managed via their account manager.

  1. What are the consequences of late or non-payment?

In case of non-payment, your account will be automatically suspended, leading to an interruption of services. If the situation is not resolved after a prolonged period, the data associated with the account (reports, recordings, etc.) will be permanently deleted.

  1. Can your account be suspended or deactivated?
  • Suspension: Your account can be automatically suspended in case of non-payment or for use not in compliance with these TCU.
  • Deactivation: Deactivation results in the permanent deletion of your user data and associated reports.

 

  1. What invalidates these Terms?

The invalidity of any clause of these TCU does not affect the validity of the other clauses, which will continue to apply.

  1. Can you waive these Terms?

The temporary or permanent non-application of one or more clauses of these TCU by GoDactyl does not constitute a waiver of the right to enforce these clauses later.

  1. Use of the services
  • Users agree to use GoDactyl in compliance with applicable laws and these TCU.
  • Any attempt of fraudulent or illegal use will result in immediate suspension or termination of the account.

 

  1. Personal data protection

GoDactyl collects and processes your personal data in accordance with applicable laws and our Privacy Policy.

  1. Limitation of liability

GoDactyl strives to provide a high-quality service but disclaims any liability in case of:

  • Temporary technical failure or service interruption.
  • Misuse of the application by the user.
  • Indirect damages resulting from the use of the application.

 

  1. Changes to the TCU

GoDactyl reserves the right to modify these TCU. Users will be notified of any changes, which will take effect upon publication.
